Project Oriented Searching Team – POST Statute

 

1. Name of the association:

a) An association named Project Oriented Searching Team (POST) is founded.

b) The centre of the association is located in Nicosia.

c) The logo of the association is as it seems below:

 

2. Objectives:

Objectives of the association are:

a. To examine, search and write the economic, social, cultural matters and concepts which are important for the society.

b. To cooperate and establish good relations with other associations, which deal with similar matters, in national or international level and develop projects.

c. To organize conferences.

d. To make research and find solutions for the issues.

 

3. Membership:

a. Any TRNC citizen who is at least 18 years old can be a member of the association.

b. Membership applications are submitted to the executive council of the association. The membership is validated by the confirmation of the executive council. The executive council has the authority to reject any membership application without giving any explanations.

c. The members are recorded in the membership book and this book stays in the association’s centre, and all members have access to this book.

 

4. Dismissal of the members:

When a member informs the executive council about his/her resignation from the association, the executive council notes the person in the membership book and dismisses the member from the membership of the association. Dismissal due to a disciplinary situation is first informed to the disciplinary council and the disciplinary council gives the final decision on the dismissal.

The dismissal process can start when a member gives information to the executive council about a disciplinary situation including another or other members. Executive council passes the information to the disciplinary council and disciplinary council meets to give the final decision. During the process, the disciplinary council examines the written defenses of the members who were involved in the disciplinary situation.

 

5. Finance of the association:

a. Membership registration fee is 10 000 000 TL (Ten million Turkish Lira) and annual membership fee is 15 000 000 TL (Fifteen million Turkish Lira). These are subject to change if the executive council finds necessary. These fees are collected by the member who is selected by the executive council.

b. Financial Contributions:  Any institutions, individuals, unions, associations or any members of the association can make financial contributions to the association.

c. An income could be attained for the association by printing and publishing magazines, newsletters, newspapers and books.

d. The social and cultural activities organized by the Executive Council could serve as financial sources.

e. A receipt is given after someone pays a membership fee or makes a financial contribution to the association. The money is put in a bank account with the two signatures of the president and the executive council member.

f. If a member does not pay the membership fee until the General Congress, this member does not have the right to vote or be a candidate in the elections.

d. Disciplinary Council

 

7. General Congress:

General Congress takes place with the attendance of the all members. It is the highest authority in giving decisions in the organization. It guides the executive council by giving decisions. It examines the financial report of the executive council from the last fiscal year and determines the budget for the new fiscal year. It elects the executive council, inspection council and disciplinary council. It can go to elections before the regular election date if the two thirds of the members request an early election.

The General Congress meets annually to create and agenda. During the meetings, it decides the rules and the regulations of the meetings in order to have the most effective participation of the members. It elects a president and two vice presidents and a presidential board is formed.

General Congress meets when the executive board finds it necessary to meet and discuss the already decided matters on the agenda. New matters can not be added to the agenda during the meeting.

If the members demand a meeting with their own agenda, they can request a meeting from the executive board and the request must be made at least by the one fifth of the members.

In extraordinary meetings the same rules and regulations applies as in the ordinary meetings. When the members of the presidential board is all in attendance, a new presidential board is not elected but if a member of the board is missing, an election takes place for her/his position.

The General Congress of the association can be fulfilled only with the 51 percent of the registered members present. Decisions could be reached with the simple majority of the attending.

The changes in the Regulations of the association and the sale of the immovable of the association could only be effected by the vote of the 51 percent of the members.

Decision reached at the General Congress and the names of the personnel elected to fill the appropriate officers of the association made known to the Ministry of Interior forthwith.

 

8. Executive Council

The Executive Council shall be responsible for the implementation of the decisions reached at the General Council and for the execution of the requirements of the matters set out by the Regulations of the association. The Executive Council consists of a Chairman and four members. The officers elected for the Executive Council carry out the division of work among themselves.

The Executive Council prepares its own budget and presents it to the General Congress in due course. The afore-mentioned budget shall include proposals for membership dues. The financial report to be presented to the General Council should be prepared by the Executive Council according to a pre-prepared form.

A member of the Executive Council should be responsible for preparing the draft financial report, another member for preparing relating to the membership, the working report of the Executive Council is prepared by the Chairman of the Council. A member of the Executive Council shall be given the responsibility of carrying out occasional inspections and preparing reports accordingly for the Chairman of the Executive Council.

In the event of the reduction of the number of the Executive Council to three including the Chairman, an extraordinary meeting of the General Congress shall be called for electing the new members to the Executive Council. In the event of the resignation of the Executive Council one, among the members should be elected to carry on as Deputy until the end of the term of duty.

The time, the date, together with the agenda of the meeting of the General Congress should be made known to all members through advertisement through the local media in at least seven days before the said meeting. The Executive Council has the right to call for an extraordinary meeting at any time. The date of the said extraordinary meeting should be made known to the members through advertisements in one of the local newspapers in at least three days before the meeting in question.

 

9. Inspection Council

Two members elected among the members shall form the Inspection Council to carry out the financial inspection of the association. The inspectors thus elected should enjoy all the rights of the Inspection Council. The Inspection Council carries out inspections any time they seem fit and inform the members of the association of their findings accordingly.

 

10. Disciplinary Council

The three-member Disciplinary Council shall be formed from among the members. One member of the Council should be differentiated as the Secretary of the Council. Disciplinary Council has all the responsibility of the disciplinary matters of the association. The Chairman of the Disciplinary Council calls the Council’s first meeting soon after the election of the Disciplinary Council. Disciplinary Council carries out its deliberations with two members present. In the event of a change of one of the members in the course of the meeting another member of the Disciplinary Council can take over but in that case the matter in hand should be taken from the beginning.

The Disciplinary Council can deal with the matters relating to the breach of peace, deformation, damage to the property of the association or the private property of the members, in dealing with these the Council observes the rules of the current Common Law but in the matters of warning, reproach or dismissal from the membership the Disciplinary Council has the right to use its own discretion.

 

11. Accounts and the Books

The Association shall have a book of petit cash, a monthly book of accounts and the annual income and expense balance sheet, a book of members, book of inventory of the office property, minutes of the General Congress and the minutes of the Executive Council and book of decisions, input-output papers and the book of visitor.

 

12. Liquidation of the Association

The Liquidation of the Association can be effected only at the extraordinary meeting of the General Congress called for the sole purpose of the liquidation and can only be fulfilled after the successful result of a two third majority of the Council. In the event of the liquidation, the properties owned by the association shall be donated to a charitable association.

 

General Principles

13. Non other than the members can use the facilities of the associations’ building.

14. All the elections and selections of the association are carried out by secret vote and open counting with the exception of the election of the Presidential Council at the General Congress where it is done by a show of hand.

In the absence of a rule to the contrary in the Regulations absolute majority shall be sought in all meetings of the association. The same shall be for decision-making.
